Private 1:1 Pilates sessions
-
Infrared sauna sessions
-
Mini retreats and wellbeing events
-
Any other classes, sessions or activities offered by Horsley Pilates
By booking or attending any Horsley Pilates service, you confirm that you have read, understood and agree to these Terms & Conditions.
1. Bookings and payment
All classes, private sessions, sauna sessions and mini retreats must be booked in advance.
Payment is required at the time of booking or in accordance with the payment arrangements agreed with Horsley Pilates. A booking is confirmed once payment has been received or the booking has otherwise been confirmed by Horsley Pilates. Places are subject to availability and are not guaranteed until the booking has been confirmed.
2. Cancellations and class swaps
Please provide at least 24 hours' notice if you need to cancel or change a group mat class booking.
Horsley Pilates offers an online class swap system via www.horsleypilates.com, which enables you to swap your mat class to another suitable class where a space is available, provided the required 24 hours' notice has been given. Class swaps are subject to availability and must be made through the online class swap system. Cancellations made with less than 24 hours' notice, and missed group mat classes, are charged in full and are not eligible for a class swap. The online class swap system applies to group mat classes only and does not apply to private 1:1 sessions, sauna sessions or mini retreats unless specifically stated at the time of booking. Horsley Pilates may, at its discretion, waive or vary the cancellation terms in exceptional circumstances.
3. Private 1:1 sessions
Private 1:1 sessions are arranged specifically for the individual client and may be tailored to their goals, experience, ability and circumstances. Please provide at least 24 hours' notice if you need to cancel or rearrange a private session. Cancellations made with less than 24 hours' notice, and missed private sessions, may be charged in full. Private sessions are not transferable to another person without prior agreement from Horsley Pilates. Private instruction is not a substitute for medical diagnosis or treatment.
4. Mini retreats and special events
Mini retreats and special events may include a combination of Pilates, stretching, relaxation, sound baths, infrared sauna, outdoor activities, refreshments or other wellbeing activities, as described in the individual event programme. Because places at retreats and special events are limited and arrangements may need to be made in advance, different cancellation terms may apply. These will be clearly stated at the time of booking. Unless otherwise stated, retreat and event bookings are non-transferable and cannot be swapped through the online mat-class swap system. Where a client is unable to attend, Horsley Pilates may, at its discretion, allow the booking to be transferred to another person where reasonable and subject to any costs already incurred.
5. Class suitability and health information
Before participating in any Pilates class, private session, sauna session or mini retreat, clients must provide accurate and relevant information about any injury, medical condition, pregnancy, surgery or other health consideration that may affect their ability to participate safely. Clients will be asked to complete and return a Body Control Pilates enrolement form, supplied at the time of booking by Horsley Pilates. This information is used to help Horsley Pilates determine whether a particular activity is appropriate and, for Pilates, to determine the most suitable class or level and enable instructors to adapt exercises where appropriate. Clients must inform Horsley Pilates of any significant change in their health, injuries, pain or other circumstances that may affect their ability to participate safely. Horsley Pilates reserves the right to recommend that a client attends a different class, receives private instruction, does not use the sauna or seeks appropriate medical advice before participating where this is considered necessary for their safety.
6. Medical advice
Pilates, sauna use and other physical or wellbeing activities offered by Horsley Pilates are not a substitute for medical diagnosis, treatment or advice. If you have any concerns about whether Pilates, sauna use or any activity included in a mini retreat is suitable for you, you should seek advice from an appropriately qualified healthcare professional before participating. Horsley Pilates instructors and staff do not diagnose or treat medical conditions.
7. Client responsibility and listening to your body
Clients participate voluntarily and are responsible for listening to their own bodies during every session or activity. You should not perform an exercise or continue an activity that causes pain, significant discomfort, dizziness, nausea, breathlessness or feels unsafe. You should inform your instructor or a member of the Horsley Pilates team immediately if you experience any concerning symptoms. Providing health information to Horsley Pilates does not remove your responsibility to communicate how you are feeling during a session.
8. Pilates instructor guidance and safety
Horsley Pilates will take reasonable care and skill in providing Pilates instruction and in selecting and adapting exercises based on the information available to the instructor. Clients must follow reasonable safety instructions given by their instructor and use Pilates equipment only as instructed. Instructors cannot know how every individual will respond to a particular exercise. Clients therefore remain responsible for communicating relevant information and following reasonable guidance throughout the session.
9. Infrared sauna
Sauna use is voluntary and clients must follow all safety instructions provided by Horsley Pilates.
Clients should inform Horsley Pilates before using the sauna of any health condition, medication or other circumstance that may make sauna use unsuitable. If you are pregnant, have a cardiovascular condition, blood-pressure concerns, are taking medication that may affect your response to heat, or have any other concern about sauna use, you should seek appropriate medical advice before using the sauna.
Clients should remain adequately hydrated and should leave the sauna immediately if they feel unwell, dizzy, faint, nauseous, excessively hot or otherwise uncomfortable. The sauna must be used only for the recommended duration and in accordance with the instructions provided by Horsley Pilates. Alcohol or recreational drugs must not be consumed before or during sauna use. Horsley Pilates reserves the right to refuse or discontinue sauna use where it reasonably considers this necessary for a client's safety.
10. Mini retreat activities
Clients acknowledge that mini retreats may involve a variety of physical, relaxation and wellbeing activities, including Pilates, stretching, sound baths, sauna use and outdoor activities. Participation in each activity is voluntary. Clients should inform the instructor or retreat host if they do not wish to participate in a particular activity or if they feel unable to do so safely. Where an activity involves specific health considerations, clients are responsible for providing relevant information in advance and following the instructions given by Horsley Pilates. Outdoor activities may be affected by weather or other circumstances. Horsley Pilates may amend the programme where reasonably necessary for safety or practical reasons.
11. Liability
Pilates, sauna use and physical or wellbeing activities involve inherent risks, including muscular soreness, strain, injury, dizziness, dehydration, heat-related effects or aggravation of an existing condition. By participating, you acknowledge these inherent risks and accept responsibility for taking reasonable care of your own safety, including:
-
Providing accurate and relevant health information
-
Following reasonable instructor and safety instructions
-
Using equipment and the sauna only as instructed
-
Listening to your own body
-
Stopping or modifying an exercise or activity if it causes pain, discomfort or feels unsafe
-
Leaving the sauna immediately if you feel unwell
Horsley Pilates will take reasonable care and skill in providing its services and in responding appropriately to information provided by clients. Where a client fails to provide relevant health or injury information, fails to disclose a material change in their circumstances, or fails to follow reasonable safety instructions, this may be relevant when determining the extent of Horsley Pilates' responsibility for any injury, loss or damage, subject always to applicable law.
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which applicable law does not permit us to exclude or limit.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
12. Equipment and studio use
Clients must follow reasonable instructions concerning the safe use of Pilates equipment, sauna facilities and the studio. Equipment should be used only for its intended purpose and as instructed by the teacher or Horsley Pilates team. Please inform a member of the team if you are unsure how to use any equipment or facility. Horsley Pilates reserves the right to prevent a client from using equipment, the sauna or participating in an activity where this is reasonably considered necessary for safety.
13. Personal belongings
Clients are responsible for their personal belongings while attending Horsley Pilates. Horsley Pilates cannot accept responsibility for loss, theft or damage to personal property except where such responsibility cannot legally be excluded.
14. Arrival and attendance
Clients should arrive in sufficient time to prepare for their class, session, sauna booking or retreat.
If you arrive late to a Pilates class or private session, your participation may be restricted where the instructor considers that joining at that point would compromise your safety or the experience of others.
Please wear suitable clothing and follow any studio guidance regarding footwear, equipment, towels, hydration and personal hygiene.
15. Respectful behaviour
Horsley Pilates is committed to providing a welcoming and respectful environment for clients and teachers.
Clients are expected to behave appropriately and respectfully towards instructors, staff and other clients.
Horsley Pilates reserves the right to refuse or end participation where a client's behaviour is abusive, threatening, discriminatory, unsafe or significantly disruptive.
16. Changes or cancellations by Horsley Pilates
Occasionally, Horsley Pilates may need to change or cancel a class, private session, sauna booking,
retreat or other event due to instructor or staff illness, unforeseen circumstances, safety considerations or circumstances beyond our reasonable control. Where this happens, Horsley Pilates will make reasonable efforts to provide an alternative session, rearrange the booking or provide an appropriate credit or refund, as applicable. For mini retreats, Horsley Pilates may make reasonable changes to the programme where necessary, including substituting an activity, instructor or facility, while seeking to maintain the overall nature and value of the experience.
17. Photography and marketing
Horsley Pilates will not use identifiable photographs or videos of clients for marketing or promotional purposes without appropriate permission. Clients should not photograph or record other clients during classes, sauna sessions, retreats or other activities without their express permission.
18. Privacy and personal information
Horsley Pilates collects and uses personal and health information in accordance with its Privacy Policy.
Health information provided during enrolment is used to help determine appropriate class or activity suitability and enable instructors and staff to provide safe and appropriate instruction. Horsley Pilates holds client information securely and does not share personal information with external booking, payment or software providers, except where disclosure is legally required or otherwise permitted by law. Further information about how personal information is collected, used and protected is provided in the Horsley Pilates Privacy Policy.
19. Changes to these Terms & Conditions
Horsley Pilates may update these Terms & Conditions from time to time. The latest version will be made available on the Horsley Pilates website. Where changes materially affect existing bookings or rights, Horsley Pilates will take reasonable steps to notify affected clients.
20. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute arising in connection with these Terms & Conditions will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights that may apply.
